Accessing, or attempting to access, the Services from any such restricted or prohibited jurisdiction is strictly prohibited and may result in the immediate suspension or termination of your account and access privileges without prior notice.

Please note that unless specifically defined in this Privacy Notice, capitalized terms shall have the meaning ascribed to them in our Terms of Service (Terms). Please read this Privacy Notice in conjunction with our Terms of Service.

This Privacy Notice applies to your use of Tongits Hub, including without limitation https://www.tongitshub.com and the Tongits Hub mobile application ("Mobile App"/"Platform") (collectively referred to as "Services") and outlines our practices in relation to the storage, use, processing, and disclosure of your personal information that you chose to share with us when you use our Services. We primarily process your Personal Data and Information to create and maintain a User Account for you and offer you our Services. You acknowledge that you provide information voluntarily and by accessing, registering, or using the Services you consent to the collection, use, process, storage, and disclosure of your personal information as described herein.

We shall comply with all applicable laws, regulations, and governmental or regulatory requirements, including, without limitation, the provisions of the Information Technology Act, 2000, the rules, regulations, and guidelines issued thereunder, and any applicable data protection or privacy laws, as may be amended, substituted, or re-enacted from time to time.

How will we use your Personal Data and Information?

The purpose of this Privacy Notice is to enable you to understand how we collect, store, share, disclose, use, and safeguard your Personal Data and Information and for you to understand your rights in relation to that information.

Account registration and access to our Services are available only through supported social login options (for example, Google, Facebook, or Apple). As part of this process, we will have access to your personal data, such as your name and email address, which are shared with us directly by the respective social platform in accordance with your privacy settings on that platform. We may also collect information such as your device location and IP address (which is not part of "Personal Data and Information") for analytics, trend analysis, operation of our gaming Platform, state tracking, and to gather broad demographic data for aggregate use.
In compliance with our regulatory requirements for you to access and use our Services, you hereby consent and permit us, and all third parties acting on our behalf of us, to: (i) use location-based services (LBS) to detect your geographic location from your personal computer/mobile phone/electronic device/mobile application ("Devices"), which may include but not be limited to your IP address and Wi-Fi connection (such as MAC address), and cookies data; and (ii) undertake the collection, storage, processing, retrieval, and transmission of your Personal Data and Information (which will include but not be limited to your location data) and/or such other data or information that may be derived from your Devices, all in accordance with the purposes described in this Privacy Notice.
When you use our Services, we receive information about your activity on the Services and information held on or derived from Devices that you use (such as your device's operating system, browser type, app version, device identifier, and crash logs), to allow us to enhance security, stability and functionality of our Services, as well as to ensure that you are not using any prohibited third party software or tools that may in any way affect our Services. We will take all reasonable efforts to ensure that the information shared by us with third parties is protected in a manner that is consistent with this Privacy Notice.
If requested by you at initial registration or by checking your marketing preferences in the "My Account" section on the Services, we may send you information by email, about our existing and new services, products, and promotions and offers in accordance with this Privacy Notice. If you do not wish to receive any information about our existing and new Services, products, promotions, prizes, and special offers from us, you can tell us not to contact you for marketing purposes at initial registration or by updating your marketing preferences in the "My Account" section of the Services or by clicking on the "Unsubscribe" link in any marketing email that you receive from us. If you request to discontinue receiving marketing communications about our promotions, we will remove your details from our marketing distribution lists.
We may use, share, or disclose your data and information including your personal and behavioural data, and/or aggregated and/or anonymized data and information to provide you with marketing and promotional content, including that of our Affiliates. This includes sharing your Personal Data and Information with contracted third-party service providers and partners who assist us to deliver Services and/or marketing or promotional content on our Platform (such as in-app messages, banners etc). These Affiliates, third parties are contractually obligated to handle your Personal Data and Information in accordance with applicable data protection laws and only for the purposes authorised by us.
By using our Services, you consent to our use of your name (full or partial), likeness, tournament wins, and other attributes, whether in an aggregated, anonymized, or identifiable form, for our marketing and promotional purposes. This may include, but is not limited to, showcasing user achievements, testimonials, and other promotional content in our advertisements, social media, leaderboards, and other communication channels.
We may disclose or share your data and information, including your Personal Data and Information and behavioural data, with one or more of our Affiliates, including for the reasons to support Platform operations, marketing, analytics, product improvement, fraud prevention, due diligence, and other business purposes, including developing or operating products and Services similar or related to us. Our Affiliates will have the right to use and handle this Personal data and Information for these purposes, in compliance with applicable data protection laws, to ensure a seamless and consistent experience across our Services.
In the event we undertake or subject to (either voluntary or under any legal process) a strategic transaction, sale (either of business or of assets), merger, acquisition, other change in control, your data and information, including your Personal Data and Information including behavioural data, may be transferred to another Affiliate or successor entity, in accordance with applicable data protection and data protection laws.

Users' Consent

Consent to the use of Personal Data and Information

All users of Tongits Hub consent to the collection, use, processing, storage and disclosure of their Sensitive Personal Data, Personal Data and Other Personal Information by Junglee Games for the purposes described in this Privacy Policy. Access to Personal Data is restricted to authorised employees, Affiliates, contracted third parties and service providers, and is granted only to those who need such access for operational, analytical, compliance, customer service, moderation, safety or security purposes or where specific consent is required under this Privacy Policy.

Users may withdraw consent for the processing of their Sensitive Personal Data or Other Personal Information by submitting a specific request to our customer support. Withdrawal of consent for any category of data may result in the immediate withdrawal of the user's ability to access Tongits Hub or any part of the Services, including tools, gamerooms, chats, gifting features, or any feature that depends on such data. Withdrawal of consent shall not restrict Junglee Games' right to use aggregated, anonymised or de-identified data for analytics, operational improvement, security analysis or other purposes permitted under applicable law, provided that such information is not personally identifiable.

JGIPL may use software tools, analytics systems, SDKs and other applications for traffic analysis, user behaviour analysis, advertisement measurement, feature performance analysis, fraud detection and security monitoring.

Consent to the use of cookies

When you visit or use the Platform, cookies or similar tracking technologies may be stored on your device. Cookies are used to personalise your experience, support authentication, facilitate room management, track gifting behaviour, improve livestream stability, analyse user engagement, measure advertising effectiveness, conduct security checks and perform data analytics. Cookies may also be set by advertisers or third-party partners whose content or embedded technology appears on Tongits Hub. Cookies placed by third-party advertisers are not controlled by Junglee Games.

By using Tongits Hub, you consent to the use of cookies. You may adjust your browser or device settings to refuse cookies; however, certain features of Tongits Hub may not function properly in that case.

Consent to email and SMS communication

When you register your email address and phone number with Tongits Hub, you consent to receiving communications from Junglee Games, its Affiliates, authorised partners and other users where relevant to platform functionality. You acknowledge that if you use referral features, invitations or sharing functionalities, Tongits Hub may send communications to referred individuals on your behalf, and those communications may display your name or email address as the sender. With your consent, Tongits Hub may access and store information relating to your contacts in order to send invitations, recommendations and promotional updates to them from time to time.

Consent to telephonic communication

Any telephonic or VoIP communication between you and Tongits Hub's customer support or moderation teams may be recorded or monitored for quality control, employee training, dispute resolution, fraud prevention and platform safety purposes.

Consent to the use of Personal Data and Information for marketing and promotions

Junglee Games may use, process, share or disclose your Personal Data and Information transaction data, behavioural data, device data and engagement data to provide you and other users with marketing, promotional or advertising content relating to Tongits Hub, its features, events, showcases, campaigns, tournaments, virtual gifting offers, or third-party promotions, including those of Junglee Games' Affiliates. This may include sharing your data with contracted service providers, advertising networks, analytics partners, campaign-management partners and external platforms that deliver promotional messages both inside Tongits Hub (including in-app messages, interstitials, banners, chat prompts and pop-ups) and outside Tongits Hub (including SMS, WhatsApp, push notifications, email, digital advertisements and social media channels).

Such service providers and partners shall be contractually obligated to handle your Personal Data in compliance with applicable data protection laws. By using Tongits Hub, you consent to the use of your name, event participation, leaderboard ranks, wins, gifts received, and other attributes, whether anonymised or identifiable, for marketing and promotional purposes on any media owned or operated by Junglee Games or its Affiliates.

Data Sharing with Affiliates

Junglee Games may disclose, transfer or share your Personal Data and Information, transaction data, behavioural data, device data, engagement data, room-usage metrics, audio-video interaction data, and other information with one or more of its Affiliates to support platform operations, improve user experience, conduct analytics, implement safety and fraud prevention measures, undertake due diligence, perform customer support, deliver marketing and advertising initiatives, and for other legitimate business purposes including developing, operating or enhancing products and services that are similar or related to Tongits Hub. Affiliates receiving such data shall be permitted to handle and use the data in compliance with applicable laws and in accordance with the purposes described herein.

In the event of a strategic transaction or legal requirement including merger, acquisition, sale of business or assets, restructuring, corporate reorganisation, change in control, insolvency or compulsory legal process, your data and information including Personal Data, transaction data and behavioural data may be transferred to another entity or Affiliate in compliance with applicable data protection and data localisation laws. The successor entity shall be permitted to continue using such data in accordance with this Privacy Policy or any updated policy that maintains an equivalent standard of protection.

Confidentiality

We make substantial efforts to protect the confidentiality of your Personal Data and Information and will not knowingly allow access to your Personal Data and Information to anyone other than to the User or as described in this Privacy Notice. You should also do your part to protect your Personal Data and Information. Your login credentials are confidential and you are obligated to keep your login credentials secret and confidential at all times and to make the best efforts to protect their secrecy and confidentiality. While we implement industry-standard security controls, no system is entirely immune from unauthorized access, and we encourage users to maintain their own device and network security.

Limits of confidentiality

Legally Required Disclosures: Due to the legal, regulatory, and security environment we may be required, as applicable, under certain circumstances, to disclose your Personal Data and Information to law enforcement agencies, government or statutory authority. They, as applicable, will make their reasonable effort to limit such disclosure to the following requirements:

Where they believe in good faith that it is required to do so in response to notice from law enforcement, court order, warrant or other legal process;
Where it is reasonably necessary to identify, contact, or initiate legal action against the person(s) or entities to preserve and/or enforce their rights.

Data Security

We implement reasonable security practices and procedures designed to protect your Personal Data and Information from unauthorized access, loss, misuse, alteration, or disclosure. These measures include encryption in transit, access restrictions, secure storage, logging, and monitoring. While we strive to safeguard your information, no method of electronic transmission or storage is entirely secure. You are responsible for maintaining the confidentiality of your login credentials and ensuring that your device remains secure.

Your rights in relation to your information

You can write to us at any time to review, change or have your details changed or corrected in accordance with your rights under applicable legislation, and in such an event we may require the evidence of your identity. To contact us regarding your information, please email our customer support in the first instance. We may in certain circumstances levy a small charge to cover the cost of administration related to any request made by you in this regard if the information is given to you in writing. Please note that if you request us to close or deactivate your User Account for any reason, your Personal Data and Information will be retained for such period as may be required under the applicable regulations or other regulatory requirements and all other applicable laws in India. Once your account is deactivated, you will not be able to access your account.

Data Retention

We retain Personal Data and Information for as long as necessary to provide the Services, meet legal and regulatory requirements, address disputes, enforce our Terms, maintain the security and integrity of the platform and comply with tax, audit and statutory obligations. Certain information may remain in backups or archives for a limited duration even after deletion requests, but such information is not used for active operations except where required for safety, legal or compliance purposes.

Account and Data Deletion

Users are entitled to delete their Tongits Hub accounts, along with their Personal Data and Information, by using the account deletion option provided on the Tongits Hub mobile app. If you proceed with the permanent deletion of your account, you will lose access to Tongits Hub and all the Services, including all user data and Personal Data and Information associated with your Tongits Hub account. When you request the deletion of your data, we follow a deletion process that ensures that your data is removed from our servers. The deletion of your account will result in the loss of all associated gameplay data, progress, and virtual items available in your Tongits Hub account.

The deletion of your account and data from our active and backup systems may take time and sometimes there may be a delay as well. Please note that some user data may be retained for the purposes of security, fraud prevention, and regulatory compliance.

Cookies

In this Privacy Notice, we use the term "cookies" to refer to cookies and similar technologies (such as web beacons) we use to store information. A cookie is a simple text file that is stored on your computer, mobile or any other device by a website's server, and only that server is able to retrieve or read the contents of that cookie. Each cookie is unique to your web browser. It will contain some anonymous information, such as a unique identifier and the website name and some digits and characters.

We also use cookies to measure the effectiveness of our advertising campaigns, to limit the number of times you see an advertisement, to remember that you have visited our Website/app/Services, and to show you advertisements that are more relevant to your interests. We may provide interactive features on our Services that allow users to communicate, such as chat, messaging. Please be aware that these communications may be monitored and/or recorded by us for purposes including compliance with our Terms of Service, prevention of fraud or abuse, ensuring the safety and integrity of our Platform, and resolving disputes. By using these features, you consent to such monitoring and recording, and acknowledge that your chats and communications may not be private when using our Services.

Third-Party Links and External Sites

Services may contain links to websites, applications, or services operated by third parties that are not owned or controlled by us. Please be aware that when you access these third-party links, you will be subject to their privacy practices and policies, which may differ from ours. We do not review, endorse, or make any representations about third-party content, privacy practices, or use of your Personal Data and Information. We are not responsible for the information or activities of these external parties, and your interactions with them are solely at your own risk. We encourage you to review the privacy policies of any third-party sites or services you visit before providing personal information.

Privacy Measures for Minors

Our Services are meant only for persons aged 18 or above. If you are under 18 years of age, you are not permitted to use our Services. If you are a parent and/or guardian and believe that we may have inadvertently collected any Personal Data and Information from your child, you can contact our customer support.

Limitation of liability

This Privacy Notice is not intended to create, and does not create, any legal rights in your favor or in favor of any other person or party. The liability of Junglee Games shall be limited to the removal of Personal Data and Information from the system of the Services and the removal of personally identifiable elements of other Personal Data and Information. Notwithstanding anything to the contrary contained in this Privacy Notice and elsewhere, the aggregate liability of Junglee Games for all claims for damages pursuant to the provisions of the Services, including claims in respect to the violation of this Privacy Notice, shall be limited to the aggregate maximum amount of liability as provided in the Terms of Service. Your continued use of the Services constitutes your agreement to this Privacy Notice and any amendments hereof.

Governing Law And Jurisdiction

This Privacy Notice shall be governed by and interpreted in accordance with the laws of India. By using our Services, you expressly agree that any dispute, claim, or controversy arising out of or relating to this Privacy Notice or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Bengaluru - Karnataka, India. You further acknowledge and agree that such courts constitute a convenient and appropriate forum for the resolution of any such disputes, and you waive any objection to proceedings in such venue, including objections based on inconvenience of the forum.

Changes To This Privacy Notice

We reserve the right to revise, update, or otherwise modify this Privacy Notice at any time, at our sole discretion. Any changes will become effective upon posting the updated Notice on our Mobile App or website, unless otherwise required by law. We encourage you to review this Privacy Notice periodically to stay informed of our information practices. If we make material changes, we may provide additional notice such as a prominent display on our Services or by sending an email notification to registered users. Your continued access to or use of the Services after such changes have been posted will signify your acceptance of the revised Privacy Notice. If you do not agree to the revised Privacy Notice, you must discontinue use of our Services and, if applicable, uninstall the application.
